Deciding on a Realtor to represent you is one of your most important decisions. If you value a knowledgeable, experienced, tech savvy, highly ethical Realtor who will act in your best interest at all times, and a highly skilled negotiator who is most concerned with helping you make an educated and informed decision, then we are perfectly suited to work together.

My services start with a passion and a commitment to every client for their complete satisfaction. Frankly, nothing else is acceptable.

They include representing buyers and sellers in traditional fiduciary relationships, assisting companies from around the country relocate their employees to the twin cities, performing Broker Price Opinions (BPO's) for Banks and Lenders with real estate owned holdings or homes in foreclosure, conducting pre-foreclosure meetings with homeowners as a loss mitigation consultant, and providing resources to connect you with many types of service professionals related to home maintenance, remodeling, and other home improvement needs.

A fiduciary relationship in real estate establishes what is called agency, and agency can take various forms depending on whether I am representing the buyer, seller, or both. Specifically, there are five classifications: Buyer's Broker, Subagent, Seller's Broker, Dual Agency, and Facilitator. An agency relationship is required by Minnesota State Law to be explained and agreed to before any real estate services are performed. (That entails showing homes to a prospective buyer or listing a home for sale for a seller.)

Basic comprehension of agency and fidcuciary duties is important in understanding how my services benefit you. What follows is a summary of agency and representation for your reference.

Buyer's Broker: A Buyers Broker looks our for the buyer's best interests and only the buyer. This relationship between agent and buyer provides the client with the full compliment of all fiduciary responsibilities including Loyalty, Confidentiality, Disclosure, Obedience, Reasonable Care, and Accounting. If broker is working with a seller as a customer representing a buyer, the agent must act in the buyers best interest at all time and must tell all information disclosed by the seller except any confidential information as may be protected under a facilitator relationship (see below).

Loyalty: Broker/Salesperson will act only in the clients' best interest.
Confidentiality: Broker/Salesperson will keep clients' confidences unless required by law to disclose information (such as disclosure of material facts to Buyers).
Disclosure: Broker/Salesperson will disclose to clients all material facts of which broker/salesperson has knowledge which might reasonably affect the clients use and enjoyment of the property.
Obedience: Broker/Salesperson will carry out all clients lawful instructions.
Reasonable Care: Broker/Salesperson will use reasonable care in performing duties as an agent.
Accounting: Broker/Salesperson will account to clients for all clients money and property received as agent.

Subagent: A broker or salesperson who is working with a buyer but represents the seller. In this case the buyer is the broker's customer and is not represented by that broker. Any information disclosed to the agent by the buyer must be disclosed to the seller and the buyer will not receive any advice from the broker nor be represented.

Seller's Broker: A broker who lists a property for sale, or a salesperson who is licensed to the listing broker represents the seller and acts on behalf of the seller. The broker must also disclose to the buyer any material facts known by broker as defined in MN statute 82.22 Subd. 8 which could adversely affect the buyers use or enjoyment of the property. A seller's broker owes to the seller all fiduciary responsibilities as listed above. If broker is working with a buyer as a customer representing a seller, the agent must act in the sellers best interest at all time and must tell all information disclosed by the buyer except any confidential information as may be protected under a facilitator relationship (see below).

Dual Agency - Broker Representing Both Seller and Buyer: Dual agency occurs when one broker or salesperson represents both both parties to a transaction, or when two agents licensed to the same broker each represent a party to the transaction. Dual agency requires the informed consent of all parties,and means that the broker/ salesperson owes the same fiduciary responsibilities and duties to buyer and seller. This role limits the level of representation the broker and salesperson can provide, and prohibits them from acting exclusively for either party. In a dual agency, confidential information about price, terms, and motivation for pursuing a transaction will be kept confidential unless one party instructs the broker or salesperson in writing to disclose specific information about him or her. Other information will be shared. Dual agents may not advocate for one party to the detriment of the other.

Within the limitations described above, dual agents owe to both Seller and Buyer the fiduciary duties described above. The broker must also disclose to the buyer any material facts known by broker as defined in MN statute 82.22 Subd. 8 which could adversely affect the buyers use or enjoyment of the property.

Facilitator: A broker or salesperson who performs services for a buyer, seller or both, but does not represent either in a fiduciary capacity as Buyers Broker, Sellers Broker or Dual Agent. The facilitator broker does not owe and of the fiduciary duties as described above, except confidentiality, unless those duties are specified in a written facilitator services agreement. In the event a facilitator broker or salesperson working with a buyer shows a property listed by the facilitator broker or salesperson , then the facilitator broker or salesperson must act as a Sellers Broker (see above).  In the event a facilitator broker or salesperson working with a seller accepts a showing of the property by the facilitator broker or salesperson , then the facilitator broker or salesperson must act as a Buyer's Broker (see above).
